Résumé

The idea of covenant that would recognize a universal right to the environment is not a new one. In recent decades, several drafts have been proposed by the civil society and the academic community, as the Third International Covenant of rights proposed by K. Vasak, the Argentine Declaration on Rights of Mankind, the Bill of Rights for Future Generations proposed by J.-Y. Cousteau or the regularly draft International Covenant on Environment and Developement of IUCN. These projects have different approaches, so there are various models of Pact. Two kind of drafts have to be distinguished: those which are State-centric, based on State obligations, and those which are based on rights. Moreover, these rights may have an individual aspect or a collective one. However, that drafts are not real “pure” model in practice. After a period of dormancy, the idea of a Global Pact has been a revival with the COP21: a Universal Declaration of Humankind Rights, conducted by C. Lepage, a Covenant on the Human Right to the Environment driven by the CIDCE and a Global Pact on the environment initiated by L. Fabius. France has been a major motor within the United Nations in order to propose the introduction of an environmental covenant. An interstate working group has been established. However, the work of this group has not succeeded for now since the adoption of a Global Pact is still pending.
L’idée d’un « pacte » qui viendrait reconnaître le droit à l’environnement au niveau universel n’est pas nouvelle. Au cours des dernières décennies, plusieurs projets de Pacte ont été proposés par la société civile et le monde académique, que l’on songe au troisième Pacte international de droits de K. Vasak, à la Déclaration argentine sur les droits de l’humanité, aux propositions de la Commission Brundtland, à la Charte des droits pour les générations futures de J.-Y. Cousteau ou au projet, régulièrement actualisé, de l’IUCN. Ces projets sont sous-tendus par des approches différentes : plusieurs modèles de Pacte existent. Il convient, notamment, de distinguer les projets étato-centrés, fondés sur des obligations étatiques, des projets basés sur les droits. De plus, les droits consacrés peuvent présenter soit une dimension individuelle, soit une dimension collective. En pratique, toutefois, les projets sont rarement des modèles purs. Après une période d’éclipse, l’idée du Pacte sur l’environnement a connu un renouveau, à la faveur de la COP21 : une Déclaration universelle des droits de l’humanité sous la direction de C. Lepage, un Pacte sur le droit des êtres humains à l’environnement porté par le CIDCE et un Pacte mondial sur l’environnement initié par L. Fabius ont été élaborés. La France a joué un rôle moteur au sein des Nations unies pour proposer l’adoption d’un Pacte sur l’environnement. Un groupe de travail interétatique a été mis sur pied. Toutefois, les travaux de ce groupe n’ont pour l’instant pas abouti : l’adoption d’un Pacte se fait toujours attendre.
