Les transferts de droit familial : de nouvelles normes dans l’Égypte romaine ?
Résumé
This paper takes into consideration the problems surrounding the transfer of family law in the ancient world in the context of the Roman province of Egypt. We limit ourselves to the study of family law. This paper will examine the old as well as the new practices linked to the integration of Egypt into the Imperium Romanum. During the Hellenistic period, this province provides a model of a region governed by not one but several legal codes. One result of the present research is to demonstrate that the singularity of Egypt essentially rests on the specificity and abundance of papyrological documentation, and not on a judicial statute that would render it fundamentally different from other provinces.
La problématique des transferts de droit dans le monde antique est prise ici en compte dans le cadre de la province romaine d’Égypte. L’étude se limite à l’étude du droit familial. Il s’agit de dresser un bilan des héritages et des nouveautés liés à l’intégration de l’Égypte dans l’Imperium Romanum. Cette province offre alors, comme durant l’époque hellénistique, le modèle d’un espace régi par une pluralité juridique. L’un des résultats de la recherche est de montrer que l’originalité de l’Égypte repose essentiellement sur la spécificité et l’abondance de la documentation papyrologique, et non sur un statut juridique, qui la rendrait fondamentalement différente des autres provinces.
